nobody should be entitled to invent a debt and then enforce it
*
Due to my declining medical conditions, I will no longer be able to provide services on a pro bono or paid basis. I have turned over my business to Lance Denha esq. to continue my mission. More on Lance later.
*
This blog, 2007-present, is 16 years old and contains all of my insights and strategies. For those lawyers and distressed homeowners representing themselves, it would be wise to do some intensive research on the blog and to copy or download the source materials.
*
The bottom line of about 2 decades of work as a lawyer and investment banker, is that virtually all foreclosures can be won by homeowners. The government does not want to encourage such challenges because it undermines a policy adopted by both Republican (starting with GW Bush) and Democratic administrations.
*
That policy was adopted because of two factors.
*
The first was an empty threat that was not understood by any policymakers. Wall Street threatened to “pull the plug” on the entire economy if the infrastructure they had created was not fully supported —even if it did violate all known laws and even common sense.
*
The second was based on a simple bias arising from the reality of campaign finance. It favors banks over consumers — a conclusion that is contrary to the preamble of the US Constitution.
*
But no amount of policy or even legal decisions can change one simple fact: the current infrastructure intentionally and permanently extinguishes any and all debts that are reported as being created. There is no unpaid loan account. Under current law, centuries of precedent, and common sense, nobody should be entitled to invent a debt and then enforce it.
*
I have won nearly all foreclosure cases in which I was lead counsel or lead legal consultant. Everyone else can also do that if they stop believing the unpaid loan account exists and insist on corroboration of the IMPLIED version of it. When that corroboration fails to be produced, any experienced trial lawyer will know what to do and how to win the balance of the case.

Neil, you have done so much for so many. My heart and prayers go out to you and your family. May you have restful, peaceful days far from this nightmare. It steals part of your soul. You deserve only the best for all you have helped. Your insight and wisdom will be severely missed.
Hi Neal,
Thank you from the bottom our our hearts, as you have given us hope and wisdom over the last 13+ years! We are still fighting while still in our home, and that is due to God’s plan, your wisdom, our amazing attorney, and lots of prayers! Like you, we have suffered many health issues, due to the undaunting stress of this never ending battle. Open heart surgery for me, and multiple long stays in the hospital for my beautiful disabled wife.
You have put your stamp on this fragile world!
I pray that you know Jesus Christ as your Lord and Savior, so that we can meet you in Heaven to celebrate together forever!
Jesus said to him, “I am the way, the truth, and the life. No one comes to the Father except through Me.” John 14:6
Thank you for all of your efforts.
Please consider preservation of your years of work through a reliable resource.
Much appreciation,
Wendy Alison Nora
Many prayers for you Neil to battle your health issues. As one frequent commentator to your blog has repeated over and over – “Health is Wealth.” The stress of battling the foreclosure fraud is massive, and I hope you will take time to slow down and enjoy the good things life does offer with friends and family for your health. Look forward to occasional posts by you as to your knowledge. I agree with your comment as to political funding being the crux of the problem we all have faced. I do believe that Clinton, by the Commodities Futures Modernization Act of 2000, along with Bush, started the free-for-all bank fraud. We simply cannot match wealthy political donations.
Best wishes and I want you to know how much I have enjoyed your blog over the years. Thank you.
I “would” have won had the house not sold at auction (new thing these days) I had an amazing Lawyer I found from your blog and the fight lasted 7 years!
God bless Neil,Thanks
I have followed you since 2006. I read alot! I stopped fighting when I was over taken by the Bank.. They didn’t get my house though even though they were relentless. I paid the price for my house dearly. But because of everything I read from you. I be came educated on the truth. You are an amazing, talented great man, that did great things for me personally. Your smarts made me fight. As of March 2018 after 10 years of a battle to date I am still in my beutiful home and we are now finally able to see our way. And decided since covid happen we might as well put in a pool and finally enjoy our family. Because unless you go through a foreclosure for years, you can’t understand the struggle, you did and your information kept me fighting. Today I just want to let you know before you retire. You were an inspiration to me. Thank You so very much for standing by me. Could not have done what I had to do with My Attorney, if I didn’t have you educating me on the total facts. Good Luck, enjoy. You deserve the greatest retirement ever!!
Wish you health and happiness. Thanks for the many years of dedication to spreading the truth.
Thank you for your years, knowledge, and sincere concern for mankind.
Your friend,
Mark Fields
Dear Neil, First, I am so sorry to hear of your declining health. I will keep you in my thoughts and prayers.
Thank you x a million. Your words have encouraged me and helped me so much. I have looked forward to your daily wisdom for years. I have notebooks filled with notes on your wise advice.
I will certainly take the time to revisit your work. I hope I have time to get it done before it’s taken down.
Just want to thank you again for all your thoughts, hard work and information for all of us. I’m a pro se. I purportedly lost my family home in 2017. It wasn’t because I was wrong but rather because I’m not a lawyer and I don’t fully know procedure. I did represent myself 37x! Including a 2 day jury trial… I refuse to give up.
Sincerely,
Janet Montgomery

I saved my home by using the information that I found on your site. Always know, you done good. I know it, and so does the good Lord. In the end, this will be all that matters.
😢I want you to know I will continue to do “The Right Thing” This year, 2023 marks 100 years of my family and I paying Real Estate taxes to the “Town” nonstop, no interruption ever. Corruption ?, you bet🧐😢 I will be 73 this year, I will continue on until the day I die, for my country and for the future for my grandchildren. My journey will not be the same without your expertise.Be well Neal, and thank you my prayers for your health and safety are made daily.
Retirement from the practice of law will be a real test of your challenge to find a new passion for which you feel relevant. Having gone through it myself also with health issues will take some time. I bury myself in fiction courtroom mysteries. There are plenty out there.
I want to thank you for all the insight and knowledge you have shared on this challenging problem.
We’ve been ‘together’ in cyberspace for 16 years – I always hoped I’d get you as my counsel; well, your grasshopper has learned more from the master than probably 10 years in law school could ever teach. I will be filing USDC DC and hope I can get you to at least listen in . . . I have only gotten this far in large part because of you – this industry probably caused more stress on your heart than anything else – so glad you’ve been in our lives Neil – I worried and checked every day just to see if you were around . . . I’m not surprised, you earned this break; please know you have left an indelible mark on me and many others; thank you for your unfathomable depth of energy, work, every day making us stronger; and we – I at least – have become strong because of you!!! Please always let us know – I’ll be scouring every single article – even if I have them to get ANON and others like ANON’s wonderful commentary. We love ya and hope your family will finally get you all to themselves!!! <3 Sincerely, Deby
Neil, I’m sorry your declining health has brought you to have to step back from this great resource.
Mr. Garfield,
I am deeply saddened to receive your farewell address. I have followed you for over a decade and have shared your articles numerous times on social media. Your knowledge and wisdom has been both an asset and a blessing to so many people. Even in your absence, homeowners and others will continue to need access to your content. If you are interested in having this website hosted by my colleague at no cost, please let me know.

Mr. Garfield,
Your work is amazing and your knowledge surpasses the majority of the people in this area of expertise. You have been a blessing to so many people who only seek to protect their family home from strangers to the transaction.
You will be missed beyond words.

Thank you a million times, Neil for all you have done to help homeowners through some tough times. I’m heartbroken that you are retiring from this blog. I could hear your voice as I read your posts each weekday. Yours was a singular voice of encouragement and knowledge while so many faced the shame and crisis of foreclosure. I was able to turn to face the giants and ride the storm out without losing the farm. I wouldn’t have had the courage without your posts. Thank you again. Keep up your piano playing in your retirement.
Sincerely yours,
Melanie

I have been reading your emails for years and will miss them very much. I wish you health and happiness.
God speed and enjoy your well earned retirement. Feel better and much, much blessings. It has been quite enlightening reading your blogs.
Thank you Neil for all that you taught everyone. I gained so much knowledge, confidence and motivation with your ability to communication in such a way that even us lay people could understand what is really going on.
I feel so privileged to be the second one to sign up for your first seminar in Los Angeles-what a treat. You gave me so much hope.
It is rare to find someone with so much empathy and their heart in the right place like you.
Can we all have your permission to quote the lead statement of this article: “nobody should be entitled to invent a debt and then enforce it” ? Right On !!
With Love and Peace,

Thank you for everything during all these years. It was amazing to be able to follow you and your information. may you have a healthy retirement.
Thank you, Neil, for all your countless years of service, dedication, and reaching out to us all. Terrific job and I certainly leaned a LOT from you and put up a hard fight!! Being a 79-year-old disabled Vietnam Veteran I just did not have the money to fight all the crooks (co-conspirators of nasty, crooked old Bank of America.
I had 5 loans initially during the years from 202 to 2009 and just paid off the last one. Colorado did contact me relative to reaching out and not sure they can do much but will provide them with a copy of my last loan statement provided by Rushmore Savings after they allegedly took over from Nationstar and then crooked old Mr. Cooper who is actually part of Nationstar and all the other corrupt lenders/servicers allegedly involved. Thanks again please stay healthy, happy, and safe. Semper Fi.

Neil, I am sorry to learn about your health conditions and how they are impairing your ability to continue your work. I just wanted to personally thank you with the upmost sincerity for your contributions. I have learned so much from you and your podcast and feel totally confident I can stand in the truth and win my case. I am not sure why you must take down your website and podcasts. I think they are invaluable. I would be happy to help manage them for you if needed. Please feel free to contact me if you’re open to that possibility Sincerely,
Adam (www.thespiritoflaw.com)
Congratulations on your Retirement! Sorry to hear about the declining health concerns.. thanks for every ounce of hope you inspire in all of us.. I didn’t find you until 2016 after my 5yrs in chapter 13 ended, being dismissed.. while I eventually succumbed to Chase and Courts.. I finally decided to let go… June 13, 2022 the property was sold at Auction $1,353,500 and subsequently flipped a couple months later for $1,812.300.
I will continue pursue some legal remedy for the loss of over $1mm equity stolen from family.. the money is nothing compared to losing the 15yrs of not being able to proudly pay day a mortgage on what was once considered our forever home.. as a family we have moved on.. purchased new home in a new community.. w 2.65% interest loan.. I’m curious how and if these low interest loans will become the new subprime trigger loans that set off the 2008 crisis..
From our family to yours.. we love you and thanks for everything.. the knowledge we have today around what’s really happing to the American Dream is abundant.. we are prepared to defend any such event in the future..
I would love if you’d consider donating your archives to Pacific Legal Foundation here in California.. they are a nonprofit organization who would do right by your years of knowledge and work.
God Bless
God Speed
Sending love and prayers..
Chip Wilkes
I met Neil in 2009, my family would not still be in our home if it wasn’t for Neil and my tenacity:). Thank you and best of health to you.
Sad to see you go . . you will be very much missed. Thank you for all you posts and help with the mtg crisis. Those caught-up in this mess will miss your expertise.
Dear Sir,
I thank you for your dedication to American Ideals and our sacred documents: The Declaration of Independence and The Constitution and Bill of Rights, at least the 1st 10!
May God Almighty bless, keep and by the Blood of Christ sanctify you as a “Man of Righteous Judgment “!
“By His stripes we are healed”! I pray Jesus Christ heal your infirmities!
Thank you,
