Ocwen guilty of wrongful foreclosure

Ocwen guilty of wrongful foreclosure

Have you been the victim of a wrongful foreclosure? Did it involve Deutsche Bank or Option One Mortgage Corporation later named Sand Canyon Corporation and later bought by Ocwen? Our legal team is reserching a possible wrongful foreclosure action against Ocwen. If you have been harmed by these entities you should contact our office by phone, email or by submitting a free case registration statement.

Ocwen has been found guilty of so much wrongdoing it’s hard to keep track of the lawsuits and settlements by them. I’ve seen first-hand, alongside my mentor Neil Garfield, the numerous wrongful foreclosures conducted by Ocwen. So many of them based on issues we are constantly warning our readers about; lost or fabricated documents fraudulently presented to the courts. They never really had control or ownership of the loans they used to foreclose on innocent homeowners.

Here is an example of a case settled in 2015 and yet we have reason to believe that their practices continue to this day.

In Mobile, Alabama, a striking verdict emerged from a jury following a week-long trial, resulting in a $400,000 award to Wilmer and Sonya Caldwell, a couple victimized by the wrongful foreclosure practices of Deutsche Bank National Trust Company and Ocwen Loan Servicing, LLC.

The heart of the matter began in late 2006 when the Caldwells decided to refinance their home with Challenge Financial, a retail mortgage lender. Fast forward four years, and they found themselves embroiled in a foreclosure they never saw coming, carried out by none other than Deutsche Bank—a name unfamiliar to them until their crisis. According to Deutsche Bank, their ownership of the Caldwell’s mortgage was part of a complex web of transactions, typical of the securitization frenzy that encompassed thousands of U.S. home loans.

However, the trial exposed a different narrative. Evidence laid bare that Deutsche Bank had never legitimately acquired the Caldwell’s mortgage. In a desperate bid to fabricate a semblance of legality, Deutsche Bank and Ocwen concocted documents both before and after the foreclosure proceedings to falsely present Deutsche Bank as the rightful mortgage holder.

“Deutsche Bank and Ocwen were fully aware of the wrongful nature of their actions. Yet, they chose to craft documents out of thin air to justify a foreclosure that was baseless from the start,” the Caldwell’s lawyer remarked.

This case highlights what we at livinglies.me have been saying for years. Millions of homeowners are the victims of wrongful foreclosure perpetrated on them by entities that do not have any legitimate claim to the mortgage they are foreclosing on. Despite their “lack of standing” to foreclose they succeed anyway because they, or there attorney’s, were not properly prepared to defend them.

The jury’s decision included $25,000 in compensatory damages and a substantial $375,000 in punitive damages, reflecting the severity of the banks’ misconduct. The Caldwells were lucky, they had a good attorney.

This case sheds light on the pervasive and often overlooked reality of wrongful Deutsche bank foreclosures—a cautionary tale for all stakeholders in the housing market, underscoring the need for vigilance and accountability in the face of banking irregularities.

FORECLOSURE DEFENSE IS NOT SIMPLE. THERE IS NO GUARANTEE OF A FAVORABLE RESULT. THE COMMENTS ON THIS BLOG AND ELSEWHERE ARE BASED ON THE ABILITY OF A HOMEOWNER TO WIN THE CASE NOT MERELY SETTLE IT. OTHER LAWYERS HAVE STRATEGIES DIRECTED AT SETTLEMENT OR MODIFICATION. THE FORECLOSURE MILLS WILL DO EVERYTHING POSSIBLE TO WEAR YOU DOWN AND UNDERMINE YOUR CONFIDENCE. ALL EVIDENCE SHOWS THAT NO MEANINGFUL SETTLEMENT OCCURS UNTIL THE 11TH HOUR OF LITIGATION.

But challenging the “servicers” and other claimants before they seek enforcement can delay action by them for as much as 14 years or more. In addition, although currently rare, it can also result in your homestead being free and clear of any mortgage lien that you contested through Quiet Title Actions. (No Guarantee). Yes you DO need a lawyer.

  1. Finally I am seeing people fight and win. Here I’ve worked my take off my whole life and never thought a bank would or even could steal my home but they did. United Bank wrongfully foreclosed on my house in every way possible and did this to many in West Virginia with no consequences. They honestly didn’t even hide it. Mine happened in 2016. The crazy thing was they were leaving people for years who were upside down and owed hundreds of thousands in there houses but if u had value like I did they wanted it. And they got it. Mine all started with a line of credit to put a unground pool in. Then the loan was was to close at the end of the project. I had paper work like it did. Fraudulent paperwork. The head banker got up resign tho after she was caught doing this. Cuz it was much deeper. They were second owner of it loan but bought out my first loan right underneath of me. I didn’t even know it was happened til cop served at 5 pm with Joyce to vacate property in 24 hours. They were mailing doc to my address I had as kid . lol. And then literally by time they were through whole process they foreclosed and put it in my credit for only $62 dollar. I owed in total 83k for both loans to be paid in full. They sold my house on the courthouse steps for 120k. Sneaking. At this time a team of well know accountants and 1 lawyer was working hand in hand buying these properties. I know this because It just so happened one of them my hub high school best friend told him about his new endeavors and how he had come up so fast and easily in the previous year. It was awful they had someone buying all these bank owned properties & flipping (there was no wor k to do to my home it was just a front to be able to sell it quick days later for A lot. and my home they did that exactly my place sold just 19 or 20 days later for $230k. (My hub friend promised him he told his partners he didn’t want ours I knew better !!! Irvencthinot was arrived law I checked Mail box daily and when I was checking the mail his name was on all the mail as the new owner of the first sale the bank did. Here I had a 19 year business had almost paid my house off and was going to he sitting pretty early. Was gonna retire successfully at 44. Not even that tho cuz money comes and goes my grandfather was a builder. My entire family lived in that 126 acre farm. And my pops gave us all land to build on to keep us together. Not to mention my home was on family land I grew up on. During this time I lost everything. Even my mind. . Both my parents suddenly died at only 58 and 62 within 3 months of each other this same time or I would continued to fight. And won. So they not only collected my money for 23 years but then illegally foreclosed I paid every single payment by check. I went to court with no lawyer because it was a cut and dry case in my opinion. They took my money every month so I never thought I’d lose. I did Lost it all. I n hoping these people can be held accountable. I’m not the only one. I know several others it’s a small town but big now. Please help me get these people. I’m a salon owner. Not a computer

  2. The statute of limitations issue can be of no consequence if the wrongful foreclosure action involves allegations of fraud or criminal activity. We would have to better understand your specific situation to see if you fit into one of the class actions we are working on or you have a possible case on your own merits. Fill out a free case registration statement and the team here at Livinglies will take a look and get back to you. https://app.practicepanther.com/IntakeForm/Create?templateGuid=fa89dd6e-ed3d-4aff-862b-e4e9d8c5447a

  3. What if you are past the statue of limitations. What if you have agreed to a loan modification if the lender dropped the foreclosure case. Are you saying you can still help if Ocwen or Deutsche were involved. What about reprisals from the servicer if we have and are still making payments per the loan modification agreement.

    1. Colleen Dwyer

      Hi Scott
      I’m in the same boat.
After 10 years OF fighting them they offered a loan Mod because I was going to appeal. Even offered to give me a payout to drop the case but was too low. I was so tired I accepted to loan mod. It was Deutche bank and SPS. I wish I could still do something too.

  4. My lender Downey sold my note but then went out of business. Successor US Bank as Trustee for the SC16 Truman Title Trust had the note for 13 years and refused to produce it. They dragged me through hell for 13 years until someone got off their ass to go find it. Broken chain of Title, fabricated documents and No endorsement either. But it was my wet ink signature so I lost. I can’t even go after gross negligence because I’m beyond the statute of limitations. I still believe however that some kind of reparation or other solution will present itself to me

    1. Hey, Carole! Search the old Yahoo Group, “Reclaim Your Securities.” An excellent, cutting-edge blog, from 400-600 pages. Get it on scribd. Scribd is one of the best investments I ever made. Legal Documents, books, magazines…. Less than ten bucks a month.

The original “Reclaim Your Securities” blog ended in 2012, but it is still very advanced & ahead of its time today. Covers foreclosures, debt collectors, criminal court. It’s amazing what they have in common. Puts you into the right ballpark. Everything’s a Trust. The Courts hide the fact they’re operating in Admiralty-Maritime while we think we’re still in Common Law. That’s why they always win. The key is taking control of your Trust back from them, then issuing some orders as Grantor/Beneficiary. Fascinating!

The big problem and issues are that people for most cases do diddly squat, and too late!.. Be pro active!

  6. I have one with Ocwen, Duetsche Bank, originating from New Century. Everything is wrong with it. 12 years on it. Contact me…I have every shred of paperwork going back to 2007.

    1. Michael Lynch

Hey Chris, I have been fighting with Deutsche Bank and Ocwen (now PHH) for over 11 years related to a New Century Mortgage Note and Mortgage. I would like to talk to you about it.

      1. Annika Eriksson

I am getting ready to appeal a fraudulent Deutsche/Owen foreclosure in Oregon. Lets exchange notes.

  7. According to SUPREME Court , by JUSTICE GORSUCH , No children, houses, property etc etc.. without a Article 3 court , without a trial a jury in a court of records, should not be taken, is against the LAW!! a CRIME,=TREASON

  8. Neil spoke a lot on the USBank as successor trustee. I am a victim of USBank collecting on a debt on behalf of the WaMu AR9 trust that my loan is not a part of. JPmorgan controlled the paperwork to lead up to the foreclosure. It’s not hard to evidence these things, but their attorney’s knock us out on res judicata or lack of standing. Select portfolio is the same as Ocwen is their actions, but its really the foreclosure law firms who are pulling the strings and committing the fraudulent claims. Without them and their immunity, none of this could be pulled off. I’m suing the law firms.
