We keep winning. People ask us all the time about our wins. Our wins can take many forms but to our clients they are all considered wins. For example, if we help a client defend against an illegal foreclosure and the pretend lender drops their case and it’s dismissed; that’s a win. The homeowner stays in their home. Unfortunately, we see these cases get refiled sometimes even with fraudulent transfers of the supposed “debt” to another pretend lender sometimes years later. At the time the homeowner had the resources to only defend against the pretend lender and not to pursue counter claims for fraud or a Quiet Title action which costs more money than the original defense. But that’s ok, we helped that homeowner with the resources they had at their disposal at the time, and they lived to fight another day; sometimes years later.
Another example of one of our recent wins happened in the land court in Massachusetts. This homeowner had a sale date and with our evidence and expertly drafted complaint they used our work with local counsel. (for a redacted version of the expert affidavit and Quiet title complaint used in this case join our private FB group where we share some of this proprietary information. You can find it here: https://www.facebook.com/groups/livinglies )
Not only was the sale date dismissed, but now they are in settlement discussions with the pretend lender to have the case dropped. That homeowner has the option to accept a settlement amount or to pursue the case to a final decision for Quiet Title in land court and end up with their property free and clear. Either way a win for this homeowner.
Another example of our winning ways comes from a wrongful foreclosure case in California. This clients home was illegally stolen and he has the resources for a full court Wrongful foreclosure complaint complete with all the evidence we documented as well as full litigation support including expert affidavit’s, discovery requests, motions to compel discover and and an expertly drafted complaint not only alleging lack of standing for them to have foreclosed but also documentation of fraud in the process. He wants his house back and he wants to see these criminals in jail and he had the resources to hire us for a full court press against them. (cost here for our services was 15k) Here is an except from his most recent offer to settle this case which he turned down.
On behalf of all defendants we represent, we are hereby offering you the sum of $30,000 in return for a filed dismissal of the entire action with prejudice, and the execution of a settlement agreement, which we will prepare, which contains a mutual and general release of all claims concerning the property and your former loan. It will require of waiver of the provisions of civil code 1542, which is standard.
You have until January 27, 2025, at 4 pm to accept these terms, which acceptance must be unconditional and in writing. Otherwise, this offer will be deemed withdrawn. It you do accept, you will have until February 5, 2025 to sign the document and return the executed request for dismissal with prejudice to me for filing. Funds will be delivered to you within 3 business days of the court entering the dismissal.
Of course most of these settlements, when they are accepted, require a non-disclosure agreement to be signed by our clients which is why we can’t publish most of them. Hopefully this client will take these criminals to the mat and we can publish the full victory. In the meantime you can see part of our complaint alleging fraud on our private facebook group.

FORECLOSURE DEFENSE IS NOT SIMPLE. THERE IS NO GUARANTEE OF A FAVORABLE RESULT. THE COMMENTS ON THIS BLOG AND ELSEWHERE ARE BASED ON THE ABILITY OF A HOMEOWNER TO WIN THE CASE NOT MERELY SETTLE IT. OTHER LAWYERS HAVE STRATEGIES DIRECTED AT SETTLEMENT OR MODIFICATION. THE FORECLOSURE MILLS WILL DO EVERYTHING POSSIBLE TO WEAR YOU DOWN AND UNDERMINE YOUR CONFIDENCE. ALL EVIDENCE SHOWS THAT NO MEANINGFUL SETTLEMENT OCCURS UNTIL THE 11TH HOUR OF LITIGATION.
But challenging the “servicers” and other claimants before they seek enforcement can delay action by them for as much as 14 years or more. In addition, although currently rare, it can also result in your homestead being free and clear of any mortgage lien that you contested. (No Guarantee).
Yes you DO need a lawyer.

With all the fraud the banks have committed, is there a reason that class action lawsuits do not work against them? It seems that many cases I have seen have similar issues, i.e. lack of equitable assignments, missing documents, etc.
Thanks for all you guys do.
They do work, unfortunately for most victims the only beneficiaries of these suits have been the state treasury via the states attorney’s general who brought the suits. We are working on one against Ocwen but they are expensive to bring forth and difficult for a small firms like ours to finance. Thank you for your support Albert. We need all the support we can get. We seem to be the only firm effective against these illegal foreclosure activities.
How is it, person injury Attorneys accept cases on contingency, and here, in essence a Personal Injury claim for a substantive right.. yet we are forced to go bankrupt trying to defend what is god given..
In other words, the practice, as it stands, the attorney gets paid. Regardless if the homeowner wins or looses. It’s a loose-loose for homeowners.
Despite our expertise and longevity in this area of law we are still a small firm and a frequent target of Banksters and their cohorts. No we don’t take cases on contingency and no there are not any guarantees. Fortunately for our many clients they do not share your opinion of our relationship being a lose/lose proposition. If you have better alternatives we recommend you pursue them but the biggest complaint our clients share with us is their difficulty in finding a lawyer that “gets it” in this area of Law. We fill that gap the best we can.
