Background: The HAMP Program

The U.S. Government launched the Home Affordable Modification Program (HAMP) as part of the Making Home Affordable (MHA) plan to stabilize the housing market after the 2008 crisis.

Through HAMP, homeowners could receive mortgage relief by modifying:

  • Interest rates

  • Loan maturity dates

  • Even principal balances

This program allowed many struggling families to reduce monthly payments and avoid foreclosure.

What Happened at Bank of America?

While many homeowners benefited, Bank of America customers were often denied access to HAMP relief.

A U.S. Department of Justice investigation uncovered troubling facts suggesting that Bank of America:

  • Intentionally delayed loan modification requests

  • Wrongfully denied refinancing applications

  • Used “bogus reasons” (such as improper notarization) to reject requests

These practices caused homeowners to suffer:

  • Excessive fees

  • Higher interest charges

  • Unreasonable delays

  • In many cases, foreclosure

The Lawsuit Against Bank of America

Today, there is an active lawsuit against Bank of America based on allegations that the bank:

  • Deliberately dishonored agreements with homeowners

  • Wrongfully denied mortgage modifications under HAMP

  • Caused financial harm through delays, fees, and foreclosures

You may qualify to join this lawsuit if:

  • You were a Bank of America Home Loan customer on or before January 1, 2009
