This Tuesday, October 25th, we will be hosting Arizona Senator Michele Reagan. Senator Reagan will be discussing foreclosure-related legislative efforts for the next session. She will be looking for our support and ideas. Please read the first two pages of the attached pdf prior to the meetings.

I gave Senator Reagan a quick wrap up of recent legislative efforts that were successfully enacted in Hawaii and Nevada. (See below.)

Next Tuesday, November 1, 2011, Valerie Edwards an attorney – partner with Koeller, Nebeker, Carlson Haluck LLP will join us. Ms. Edwards Valerie Edwards with Koeller, Nebeker, Carlson Haluck LLP is one of the key attorneys working on the MERS Multi-District Ligitation case in which all plaintiffs were eventually dismissed with prejudice. The last of the dismissals were summarily processed by Judge Tielborg. Ms. Edwards will be giving us an overview of the proceedings and filling us in on an appeal which is scheduled to be filed prior to November 1st.Here is a link to Judge Tielborg’s Order:

You can capture the essence of the bill’s adaptations of the SB1259 efforts just by looking at the highlights on pages 1 and 2 of the attached pdf. The interesting thing about this bill is that Nevada’’s legislature essentially poured the last proposed SB1474 amendment (formerly SB1259, See attached Word document) into their legislation. Nevada graciously adopted the concept that it is the Trustee that needs to be held to account as they are being the unaccountable heavies for the mercurial foreclosing entities.
Nevada Assembly Bill 284 was introduced in Nevada on March 15, 2011 and enacted into Nevada state law on October 01, 2011.
Contrary to the post-mortem soliloquy made on the House floor about Arizona never seeing another loan from a bank if SB1474 had been amended, Nevada has not suffered any published adverse repercussions from the enactment of NV AB284 to date.
The goal of our legislative effort is to give the tens of thousands of Arizonans who are facing difficult times the opportunity to hold to account the foreclosing entities who are so brazenly flaunting Arizona’s foreclosure statutes. (Not to mention the abuse we are suffering in court. But that’s an argument for a different arena unless our legislators are willing to step up and make a needed change in the election laws for state judges.)
Additionally, as a result of published accounts of Arizona’s grass roots efforts on SB1259, a group of Hawaiian homeowners was able to directly help Hawaii enact some very appropriate legislation in their last session.
